This End User License Agreement (the "Agreement") is between you, the person or organization installing or using the software, and Stefan Tribble ("we", "us"), the maker of FlipBack Replay. It covers the FlipBack Replay software, its updates and its documentation (together, the "Software"). By installing or using the Software, you accept this Agreement. If you don't accept it, don't install or use the Software.
1. License
We grant you a non-exclusive, non-transferable license to install and use the Software on the number of computers your license covers, as shown on your license or receipt, for your own productions, including commercial, broadcast and streamed productions. The Software is licensed, not sold.
2. Restrictions
Except where this Agreement or the law allows it, you may not:
- copy the Software, other than installing it under your license and keeping backups;
- rent, lease, lend, sell, sublicense or redistribute it, or offer it as part of a hosted service or a hardware product you sell, without our written permission;
- modify, decompile, disassemble or reverse engineer it;
- remove or change any copyright, trademark or license notices; or
- get around any license keys or technical limits.
3. Your content
Recordings, clips, playlists, stills and exports you make with the Software belong to you, and we claim no rights in them. You're responsible for having the rights and permissions to record, replay and distribute what you capture.
4. Live use
Test the Software with your cameras, network and other equipment before you use it on air, and keep copies of any recordings you can't afford to lose. We aren't responsible for missed replays, lost recordings or interrupted programs.
5. Open-source components
The Software includes open-source libraries, including Qt (GNU Lesser General Public License version 3) and FFmpeg (GNU Lesser General Public License version 2.1). They're licensed to you under their own licenses, which are listed in Third-party notices, installed with the Software and shown in Settings > About and legal. Nothing in this Agreement limits your rights under those licenses. In particular, you may replace the LGPL libraries with your own versions, and reverse engineer the Software as far as needed to debug those changes.
6. NDI® software
The Software includes NDI® software and technology licensed from Vizrt NDI AB. Vizrt NDI AB and its licensors own all copyright and other rights in the NDI software. You may not modify, reverse engineer, decompile or disassemble the NDI software, or copy, distribute or create derivative works of it, except as the law allows. The NDI software is provided "as is": Vizrt NDI AB and its licensors give no warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and are not liable for any damages, whether direct, indirect, incidental or consequential, arising from it. You must comply with all export laws and regulations that apply to the NDI software, and you may not remove its copyright notices. NDI® is a registered trademark of Vizrt NDI AB. More at ndi.video.
7. Updates and support
We may release updates that fix problems or add features. Updates are covered by this Agreement unless they come with their own terms. Support is by email at hello@flipbackreplay.com.
8. No warranty
To the extent the law allows, the Software is provided "as is", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that it will be error-free or run without interruption. If you're a consumer, this doesn't affect rights the law gives you that can't be excluded.
9. Limitation of liability
To the extent the law allows, we aren't liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue, data or recordings, even if we were told they were possible. Our total liability under this Agreement is limited to the amount you paid for your license. These limits don't apply to liability that can't be limited by law.
10. Termination
This Agreement continues until it's terminated. It ends automatically if you don't comply with it, and you can end it at any time by deleting the Software. When it ends, stop using the Software and delete all copies. Sections 3 to 6, 8, 9 and 11 to 13 continue to apply.
11. Export
You must comply with all export control and sanctions laws that apply to the Software, and you may not use or export it in breach of them.
12. Governing law
This Agreement is governed by the laws of the State of Mississippi, USA, without regard to its conflict of law rules. If you're a consumer, you keep the protections the law of your country gives you.
13. Entire agreement
This Agreement, together with any terms you accepted when you bought your license, is the entire agreement between you and us about the Software. If any part of it can't be enforced, the rest stays in effect. If we don't enforce a right, we haven't waived it.
